Rehnquist Not Retiring

This just in:

Chief Justice William Rehnquist announces he has no plans to step down, will serve as long as his health permits.

Good for him.


  • Well, given his age & health (thyroid cancer, etc), that might not be a very long period of time... but I do hope he can somehow stick it out 'til we oust Bush; this president has already had way too many chances to misuse his power. Rehnquist is a wingnut, but at least he's a known wingnut.

  • Bush will not have the opportunity to choose Rehnquist's successor. Here's why:

    If there's anything Rehnquist believes in, it's the power and prestige of the Court. He very strongly supports and fights for the Court as an independent entity, transcending especially politics.

    Now, the longer he waits to retire, the closer it gets to the 2008 campaign. The last thing he wants to see is a Court appointment being a campaign issue.

    In fact, if you think about it, this summer is really the last summer for 4 years where a confirmation would not be a campaign issue. Next year is the 2006 Senate races, then 2007 is the beginning of primary season, and 2008 is the core of the Presidential race.

    I believe Rehnquist knows this, and that by not retiring this summer, he believes he'll be able to make it until the summer of 2009.
